By accessing or using the Her Storyverse™ website ("Site"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Site. We may update these terms at any time, and continued use means you accept the updated terms.

All content on this Site—including videos, images, logos, music, text, characters, story titles, designs, and branding—is owned by Her Storyverse™ or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may view, share links to, and enjoy the content for personal, non-commercial use. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit our content without our prior written permission.

When using the Site, you agree not to:

• Use the Site for any unlawful purpose.
• Attempt to interfere with the Site's security, servers, or availability.
• Impersonate another person or misrepresent your affiliation with us.
• Harvest information about other visitors without consent.
• Upload or transmit harmful code, spam, or abusive content.

If you submit ideas, feedback, stories, photographs, or other materials to us ("Submissions"), you represent that you own them or have all necessary rights and consents to share them, including consent from anyone depicted. You grant us a non-exclusive, royalty-free, perpetual license to use, modify, and display those Submissions for purposes related to the Site or our creative work. We are not obligated to keep Submissions confidential or to compensate you for them. Do not submit anything you consider confidential, or any image of another person without their permission.

Her Storyverse™ stories, artwork, and videos are created with the assistance of artificial intelligence tools alongside human creative direction. By using the Site you acknowledge that:

• Our content may be partially or wholly AI-generated, and characters, places, and events are fictional. Any resemblance to real persons (other than authorized commissioned likenesses) is coincidental, and content should not be relied upon as factual, authentic, or verified.
• AI-generated content may contain inaccuracies, artifacts, or unexpected results. We do not guarantee its accuracy, realism, or suitability for any purpose.
• We own all rights in the content we create and publish, including AI-generated content, to the fullest extent permitted by law. No rights are transferred to you by viewing or sharing links to it.
• You may not use our content—AI-generated or otherwise—to train machine-learning models, create derivative works, or for any commercial purpose without our prior written consent.

If we offer personalized or commissioned features that let you upload photographs or other materials, additional terms will apply at that time, including your representation that you are the person depicted or have their legally valid consent.

We respect the intellectual property rights of others. If you believe content on the Site infringes a copyright you own or control, please send a written notice to info@herstoryverse.com including:

• Your physical or electronic signature, or that of a person authorized to act for the copyright owner.
• Identification of the copyrighted work claimed to be infringed.
• Identification of the material you claim is infringing and where it appears on the Site.
• Your name, address, telephone number, and email address.
• A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act for the owner.

We may remove or disable access to material identified in a valid notice, and we may terminate access for repeat infringers. If you believe material was removed by mistake, you may send us a counter-notification with your signature, identification of the removed material and where it appeared, a statement under penalty of perjury that removal was a mistake or misidentification, and your consent to the jurisdiction of the federal courts in your district (or the Central District of California if you are outside the United States). Knowingly submitting a false notice or counter-notification may result in liability for damages, including costs and attorneys' fees.

The Site may contain links to third-party websites (such as Etsy, YouTube, Patreon, Pinterest, Instagram, or TikTok). We are not responsible for the content, practices, or terms of those third-party sites.

The Site and its content are provided "as is" for entertainment and promotional purposes. We make no warranties that the Site will always be available, error-free, or free of harmful components. Use the Site at your own risk.

To the fullest extent permitted by law, Her Storyverse™ and its team will not be liable for any indirect, incidental, special, punitive, or consequential damages, lost profits, or lost data arising from your use of or inability to use the Site. In any case, our total liability to you for any claim arising out of or relating to the Site or these terms is limited to the greater of the amount you have paid us in the twelve months before the claim or one hundred U.S. dollars (US $100). Nothing in these terms limits any mandatory consumer rights you have under applicable law.

You agree to indemnify and hold harmless Her Storyverse™ from any claims, damages, or expenses arising out of your violation of these terms or your use of the Site.

These terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles.

To the fullest extent permitted by law, any dispute arising out of or relating to these terms or the Site will be resolved by final and binding arbitration administered by a recognized arbitration provider in Los Angeles County, California, before a single arbitrator, in English. You and Her Storyverse™ each waive the right to a trial by jury.

You agree that any claims will be brought only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person's claims without both parties' consent.

Notwithstanding the above, either party may bring an individual action in small claims court, and either party may seek injunctive relief in court for intellectual property infringement. If the arbitration agreement in this section is found unenforceable, disputes will be resolved exclusively in the state or federal courts located in Los Angeles County, California.

We may revise these Terms of Service at any time. The updated version will be posted on this page with a revised effective date.
